Greetings,
This morning we thought we would suggest something that might help us all determine what is going on in our country, even now that Trump is in office.
It is evident that the act of governing a constitutional Republic is a difficult task where generally that Constitution is constantly questioned, challenged, and tested. It happens everyday. This activity is the greatest reason that attorneys continue to enjoy job security. Interpretation of the law becomes very difficult when words are constantly being re-defined by those that believe that words do not necessarily mean what they mean or that they meant something different some 200 years ago as they were used then. Language and intent is constantly challenged. Judicial opinions do not necessarily embrace intent. That is why they are called opinions.
Just know that a Duck yesterday is still a duck 200 years later. If it waddles, has feathers, lay eggs, quacks, poops on your deck and hangs out in the pond, it is most probably a Duck. Your feelings are not incorrect and your frustrations are well founded.
If we are feeling tired of the split in our society, if we are worn out with the constant challenges that occur everyday in our court rooms, please know that the judiciary thrives on that stuff. It is no surprise that this waltz continues because the judiciary make a living, a good living, accommodating us in our efforts to shrink or elongate our laws to usurp the intent of any particular law. Unrequited doubt can change a ruling. It is a dance of definitions, intent, precedent, opinion and semantics then skewed in some cases, by the various degrees of wisdom held by a jury of 12. It is important to note in our present day that definitions are attacked, intent is ignored, opinion is not necessarily trustworthy, precedent is a good way of not doing ones job, and semantics are always skillfully employed to emotionalize response.
BUT, the good news is that there are reasons, solid reasons, that continually confound common sense laws that simply would otherwise make our country safer, more solvent and afford the voting constituency their will. Common sense is often left in the hallways because a judge cannot interpret such a law or worse, his opinion moves him away from a common sense ruling for a hundred reasons. A few of those reasons may be some sort of personal prejudice where ego, notoriety, or precedent trumps his fair decision. And that is why there is an opportunity for appeal to a different higher court.

Often, Time is of the Essence as demonstrated in late WWII, when the decision to use the Atomic Bomb was decided by our President at the time. There was no time to deliberate thru debate this topic congressionally, while thousands were dying daily. This was a horrific decision where many thousands of people lost their lives, (maybe 200 thousand Japanese) but it remains a fact, that dropping two bombs saved millions of lives (Japanese and American) to end that war!

Beware: Endowments to our learning institutions are an Achilles heel that could prevent or pervert our Constitutional Republic. We need to become more concerned where some of these endowments come from and what caveats are attached to such gifting. Most of these type gifts should be unlawful. As they say, If it looks like a duck, smells like a duck, quacks like a duck and is greasy, it is probably a Duck. Endowments all come with Caveats.
Be Aware: We can continue our desire for diversity, we can continue our various types of worship and we can continue to seek a perfect balance in governmental and societal discussions, but we must do it all the while protecting our constitution as Americans or we will lose the right to any such discourse. That duck is and always be a duck.
